Director Disclosure Update
CAP-XX announces the following amended disclosures in relation to Pat Elliott, Non-Executive Chairman of the Company. These disclosures were made correctly by Mr Elliott to the Company's nominated adviser at the time of his appointment to the board in 2011 and subsequently, but neither Mr Elliott nor the Company was advised that these matters required disclosure under the AIM Rules. The disclosures are made pursuant to AIM Rule 17 and Schedule 2(g) of the AIM Rules.
T O'Connor Holdings Limited, a company of which Pat Elliott was a director, entered into receivership and was later liquidated in March 1998. The Company had a total deficit to creditors of A$15 million. The deficit when the receiver was appointed was A$13.9 million on the statement of claim. Secured creditors (banks and providers of performance bonds) received a full repayment of capital, but not penalty interest to which they may have been entitled.
In addition, Telminex NL, a company of which Pat Elliott was a director, entered into administration in 2004 and a deed of company arrangement was completed in March 2010. All external creditors were paid in full.
