DCC WILL NOT APPEAL APPOINTMENT OF INSPECTOR TO EXAMINE
SPECIFIC ISSUES RELATING TO
DCC GROUP'S SHAREHOLDING IN FYFFES
BETWEEN 1995 AND 2000
The boards of DCC plc, S&L Investments Limited and Lotus Green Limited have decided not to appeal the appointment by the Irish High Court on 29 July 2008 of Mr Bill Shipsey SC as an Inspector under Section 8 of the Irish Companies Act, 1990.
The terms of reference of the Inspector are limited to investigating the affairs of the three companies in respect of the transactions which were related to the acquisition, maintenance, transfer and disposal of the beneficial and legal interests of those companies in Fyffes plc between February 1995 and April 2000 (with particular reference to the periods between early February 1995 and end September 1995, and early November 1999 to end April 2000) and to examine whether those transactions involved breaches of the Irish Companies Act, 1990. The Inspectorship does not relate to the ongoing business of the Group.
DCC's focus will be to facilitate a timely conclusion of the inspection, given the very specific issues to be examined by the Inspector.
