DNO International ASA anla søksmål mot Oslo Børs ASA vedrørende gyldigheten av
børsklagenemndas vedtak om et overtredelsesgebyr mot DNO for brudd på
opplysningsplikten til børsen. Hovedforhandlingene i saken ble avholdt i slutten
av november i år. Oslo tingrett har nå avgitt sin dom, og DNO konstaterer at
selskapet ikke har vunnet frem i Oslo tingrett i denne saken.
DNO anførte at vedtaket fra børsklagenemnda og det tilhørende
overtredelsesgebyret, var ugyldig på flere grunnlag. Sentralt i saken var
spørsmålet om Oslo Børs i det hele tatt hadde lovmessig rett til å ilegge et
slikt overtredelsesgebyr. For øvrig reiste saken spørsmål om tolkning av
rekkevidden av overtredelsesgebyrbestemmelsen, omfanget av opplysningsplikten og
selskapers rett til et vern mot selvinkriminering.
Ved første gjennomlesing er den umiddelbare vurdering at flere av DNOs anførsler
hverken er nevnt eller vurdert av tingretten. DNO er uenig i dommens premisser,
og det er sannsynlig at avgjørelsen vil bli anket.
