Higher Regional Court of Frankfurt - Decision - 26 February 2019
An oral hearing in the appeal proceedings relating to the Quartier 206 Shopping Centre Borrower Claim took place on 26 February 2019 before the Higher Regional Court of Frankfurt, Zeil 42, 60313 Frankfurt am Main, in Building D, Room 101.
The Higher Regional Court of Frankfurt rendered the following decision (without grounds for the decision provided yet, the grounds are expected to be provided separately):
· The Quartier 206 Shopping Centre Borrower's appeal against the judgment of the court of first instance rendered on 10 November 2017 is rejected.
· The Quartier 206 Shopping Centre Borrower must bear the costs of the appeal proceedings (in accordance with the applicable costs and fee schedules).
· A further appeal is not permitted.
This decision is subject to any legal remedies (including by way of a complaint to the German Federal Supreme Court against denial of leave to appeal) that may be lodged by the Quartier 206 Shopping Centre Borrower.
